Decree-Law no. 23/2025 has been published, ensuring the implementation of Regulation (EC) no. 1223/2009 on cosmetic products. The decree comes into force on March 24, 2025 and establishes new rules to guarantee the safety of cosmetics on the Portuguese market.
Objective of the Decree-Law
The main objective is to guarantee the safety of cosmetic products available on the Portuguese market, protecting the health of consumers and ensuring the proper functioning of the internal market.
Registration of Operators’ Activities
Economic operators who manufacture, import or distribute cosmetic products in Portugal must register their activity. This measure aims to increase control and safety over products on the market.
Mandatory Information on Cosmetic Products
The law defines standards for product labeling, including the obligation to include clear and specific information about cosmetics. It also stipulates the language to be used for the information.
Standards for Non-Prepackaged Products
Rules are established for cosmetic products that are not pre-packaged or that are packaged at the point of sale, ensuring that these products also comply with safety requirements.
System for Reporting Undesirable Effects
The Decree-Law provides for a system for reporting undesirable effects of cosmetic products. This involves health professionals, other professionals who use cosmetics in their activities, and consumers, with the aim of guaranteeing the continued safety of the products.
Sanctions regime
The decree also establishes a sanctioning regime for infringements of the provisions of the European regulation and national legislation, with penalties for operators who fail to comply with the established rules.
With the entry into force of Decree-Law No. 23/2025, Portugal strengthens the regulation of the cosmetics market, bringing it into line with European regulations and ensuring greater protection for consumers.
